Providence Park SMS Messaging Terms of Use
Providence Park Guest Services Text Programs
Effective Date: October 13, 2026
1. Acceptance of Terms
These Providence Park SMS Messaging Terms of Use (“Terms”) govern your use of the Providence Park Fan Conduct TXT Alerts program (971-407-1PDX / 1739), operated by Peregrine Sports LLC (“we,” “us,” or “our”), and any other guest text-in assistance line we operate at Providence Park (each, a “Program”). By texting a Program number, you agree to these Terms and to our Providence Park SMS Messaging Privacy Policy, which is incorporated by reference. These Terms supplement, but do not replace, any other terms of use referenced elsewhere on our websites or applications or otherwise provided to you. These Terms incorporate by reference the Arbitration Agreement, Class Action Waiver, and Jury Trial Waiver located at https://www.mlssoccer.com/legal/terms-of-service that affect your legal rights. If you do not agree, do not text a Program number.
2. Description of Service
A Program allows you to text a published number to report a fan conduct, safety, or security concern (or, for other Programs we may operate, another stated purpose) during an event at Providence Park. Program staff review inbound texts and, in their discretion, may dispatch appropriate personnel to respond. Each Program is guest-initiated: we send messages only in reply to a text you send us first, and we will not use your mobile number to send you marketing or promotional messages through a Program.
3. Eligibility
You must be at least 13 years old and have the legal right to use the mobile number you text from to participate in a Program. By texting a Program number, you represent that you meet these requirements and that you are either the account holder for the mobile number used or have the account holder's permission to use it.
4. Message Frequency, Fees, and Opt-Out
Message frequency varies based on your individual conversation with us and is limited to the matter you contact us about. Message and data rates may apply, as determined by your mobile carrier; we do not charge a separate fee for Program messages. Reply STOP at any time to a Program number to stop receiving messages; you will receive one final message confirming your opt-out. Reply HELP at any time for assistance, or contact us using the information in Section 11. No purchase is necessary to participate in a Program.
5. Acceptable Use
You agree not to use a Program to:
- Submit false, misleading, or malicious reports;
- Harass, threaten, or abuse venue staff or other individuals;
- Send unlawful, obscene, or unauthorized commercial content; or
- Interfere with or disrupt the operation of a Program.
We reserve the right to disregard, decline to respond to, or report to appropriate authorities any message that violates these Terms.
6. No Guarantee of Response Time
While we aim to respond to Program messages promptly during events, a Program is not a substitute for calling 911 or venue emergency services in the event of an emergency. Do not rely on a Program for time-critical, life-safety situations; call 911 or notify the nearest venue staff member directly.
7. Disclaimer of Warranties
Programs are provided on an “as is” and “as available” basis. We do not guarantee that a Program will be uninterrupted, timely, secure, or error-free, or that every message will be received or responded to. Message delivery depends on factors outside our control, including carrier network performance. Peregrine Sports LLC, Major League Soccer L.L.C., Soccer United Marketing, LLC, their respective affiliates and service providers, any mobile carriers, and all of their respective officers, employees, and agents are not liable for delayed or undelivered messages.
8. Limitation of Liability
To the fullest extent permitted by law, Peregrine Sports LLC, Major League Soccer L.L.C., Soccer United Marketing, LLC, their respective affiliates and service providers, any mobile carriers, and all of their respective officers, employees, and agents, are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, a Program, including delayed or undelivered messages or any failure or delay in responding to a message.
9. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for legal or operational reasons. The “Effective Date” above reflects the date of the most recent update. Continued use of a Program after changes are posted constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law principles. If any claim is determined not to be subject to arbitration, the exclusive jurisdiction and venue for proceedings concerning such claim, as well as for any action challenging the enforceability of these Terms, shall be the federal or state courts of competent jurisdiction sitting within Multnomah County, Oregon.
